Who has access to Crown land?
Peter and Sylvia Kruszewski want to know why a fence across the beach at the Cabana Beach Campground on Osoyoos' Lakeshore Drive is allowed to remain.
The Kruszewskis have been the owners of the neighbouring Tamri Motel and Campground since 2002, and they are at odds with Cabana Beach owner Gary Jackle.
Mr. Jackle claims that his beach is private, and for three years now we have had problems with our guests being told to get off 'his' beach, Peter Kruszewski said.
Kruszewski has been trying to resolve the matter and has contacted Neil MacLennan, A/Section Head for Land and Water British Columbia (LWBC).
They also received a letter May 6, 2005 from the LWBC Southern Service Region's (located in Kamloops) Steve Carr, who said he would look into the situation.
With very few exceptions, the beaches along lakes in the Southern Interior are Crown land and should be open for public use, Carr wrote.
I am not familiar with the current situation but note that some similar concerns were raised back in 1996. We will be investigating the matter and once we have further information will determine what action will be necessary.
The Kruszewskis are tired of the dispute which has gone on as long as they have owned the Tamri, but they are considering legal action to have the fence removed.
Sylvia Kruszewski is frustrated by what she feels is endless and time-consuming bureaucracy and people passing the buck and ignoring the situation.
They initially contacted Land and Water B.C. back in April, hoping to see the situation resolved before the summer season.
The same issue was raised in 1996 by a previous owner, but nothing has changed. I'm tired of this, Sylvia said. We are just asking that he obey the rules. Now he has a large pontoon boat tied to the end of the fence which further blocks public access.
If the fence is illegal, he should take it down. And he shouldn't have the right to tell people to get off Crown land, calling it 'his' beach, she added.
The Osoyoos Times tried to contact Cabana Beach Campground owner Gary Jackle to get his side of the story but were told he preferred not to comment.
