An Osoyoos man is serving one year of probation after pleading guilty to two assaults in Osoyoos in April 2019.
Peter Scott Brennan, 44, was granted a conditional sentence in provincial court in Penticton on Aug. 13.
Brennan pleaded guilty to two assaults in April 2019 and one breach of a court-ordered condition not to consume alcohol.
Neighbours witnessed Brennan assault his ex-wife grappling with her and pushing her to the ground in her home after an argument on April 13, 2019.
Following that incident, on April 27, 2019 Brennan destroyed the windows on his roommate’s car with a propane tank following an argument, before throwing his roommate to the ground in front of police officers.
Defence counsel Norm Yates said Brennan has since paid the $1,100 in restitutions to his former roommate.
Brennan also pleaded guilty Thursday to breaching court-ordered conditions not to consume alcohol when police discovered him intoxicated at the Sage Pub on June 11, 2020, after the pub had called RCMP due to an “intoxicated male who was attempting to fight people,” Crown counsel John Swanson said.
Court previously heard Brennan had no prior criminal record, however a charge out of Edmonton in 2012 for failing to provide a breath sample to police was discovered by the courts. The discovery of the dated criminal record led Yates to drop his argument for a conditional discharge which would not appear on a criminal record. Instead Crown and defence agreed to a joint submission of a 12 to 18 month conditional sentence, which does not require jail time to be served.
Judge Michelle Daneliuk noted multiple aggravating factors while handing down her sentence Thursday including the assault which occurred while on bail for a previous assault, Brennan assaulting the mother of his children and the role alcohol played in two of the convictions.
Brennan’s probation includes conditions not to consume alcohol, not to contact his ex-wife outside of arrangements for their children and not to contact his former roommate.
