A downtown building has allegedly run afoul of the BC Building Code and Oliver’s own building regulation bylaw.

Town staff have recommended to council that they file a notice on title regarding the contraventions at 6228 Main Street (above Gecko’s Grill). The notice on title will make future owners aware of the contraventions. The registered owner is Casa Luna Cuisine Corp. from Vancouver.

According to building official Faruq Patel, renovation work was carried out without permits and inspections, resulting in the building being in an “unsafe condition.”

In his report, Patel states the town became aware in September of 2020 of an unlicensed vacation rental (three dwelling units) on the second floor.

An inspection of the units lists multiple contraventions including inadequate fire separation between suites and unprotected openings at a zero property line setback.

Patel wrote that the Town has repeatedly notified the property owner regarding the lack of permits and subsequent contraventions, but the owner has “refused to comply.”

Council will discuss the issue at tonight’s regular meeting.
