Town of Oliver Councillor Jack Bennest

Legal opinion sought by the Town of Oliver has cleared Councillor Jack Bennest of conflict of interest allegations relating to a recent motion he submitted to council.

At a special closed meeting on May 4, the Town approved a resolution to release the following statement:

“Council has received a legal opinion and council is satisfied that Councillor Bennest is not in conflict of interest on the notice of motion matter.”

The councillor’s motion for debate related to supporting the province in acquiring land to protect local grasslands and endangered species.

Bennest maintains it’s not about the national park at all.

But businessman Jim Wyse expressed his concern that Bennest was in a potential conflict of interest  for raising the issue with council while being the publisher of Oliver Daily News. He said the councillor stood to benefit from the motion.

On Tuesday, Bennest said he actually made the call requesting a legal opinion to protect the Town of Oliver

“Council was unanimous. The legal firm has now reported back stating no indication of any conflict. This is not the first time – maybe not the last time – someone will think their opinion is better than the law.”

Bennest said council will move forward to debate his original motion “that does not mention the national park.”

Mayor Ron Hovanes said seeking the legal opinion was a healthy exercise.

“It allows us to move forward without that cloud following us. In the end, unless there is a challenge from the public or council, it is up to the individual to declare a conflict.”
